Privacy Policy

1. Who we are

InstaCapital Funding (“InstaCapital,” “we,” “us”) is a business financing brokerage operated by Instacapital LLC, a Wyoming limited liability company with its principal place of business at 30 N Gould St #68485, Sheridan, WY 82801.

We are not a lender. We present business financing applications to third-party funding sources. This policy explains what we do with the information you give us in the course of that work.

2. Information we collect

Information you give us

• Application information. Business legal name and DBA, industry, state, business structure, time in business, average monthly deposits, funding amount sought, and whether you carry existing advances or loans.
• Contact information. Your name, business email address, phone number, and preferred contact time.
• Supporting documents. When your file moves forward, business bank statements, a signed application, government-issued identification, a voided business check, and in some cases proof of business ownership. These are collected through a third-party encrypted electronic signature platform, not through this website.
• Communications. Messages you send us by form, email, phone, or text, and our notes about them.

Information we collect automatically

• Consent records. When you submit an application we record the date and time, the page address, your browser’s user agent string, your IP address, and the exact text of the authorizations displayed to you. We keep this to document what you agreed to and when.
• Usage data. IP address, browser and device type, referring page, pages viewed, and time on site, collected through analytics as described in section 11.

Information from others

Funding partners may tell us the status or outcome of an application we submitted. If you reached us through a marketing or lead partner, we receive the information you gave them along with the record of the consent you provided at that time. We may also receive business information from commercial data sources.

Consent you gave to another company does not enroll you in our text message program. We send text messages only to people who have opted in with us directly, as described in section 6.

Funders evaluating your file may obtain consumer or business credit reports directly. Those reports are obtained by the funder under the authorization contained in their own application documents, and the funder — not InstaCapital — determines when and what type of credit inquiry is made.

3. How we use information

• To present your application to funding partners in order to obtain offers for you
• To communicate with you about your application, offers, and documents
• To maintain records of consents and transactions
• To operate, secure, and improve this website
• To comply with law, respond to legal process, and enforce our agreements
• To send you marketing communications by email, where you have not opted out

4. Who we share information with

• Funding partners. When you authorize us to shop your file, we present it to one or more third-party funding sources in order to obtain offers for you. We submit only to sources whose requirements match your file, and you may ask us at any time which ones received it. Once a funder receives your information, that funder’s own privacy practices govern what it does with it.
• Service providers. Companies that operate parts of our business under contract — electronic signature and document storage, email and messaging, customer relationship management, hosting, and analytics. They may use your information only to perform services for us.
• Professional advisors. Attorneys, accountants, and auditors, as needed.
• Legal and safety. Where required by law, subpoena, or legal process, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.
• Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this policy’s continued application to the transferred information.

We do not share mobile phone numbers or text message consent records with any of these parties for their own marketing purposes. See section 6.

5. We do not sell your information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We do not transfer your application to lead buyers, lead aggregators, marketing lists, or data brokers.

Sharing your application with funding partners is done to obtain financing offers for you, at your direction, and is not a sale.

6. Phone calls and text messages

Mobile information and text message consent are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text message originator opt-in data and consent are not shared with any third parties, excluding aggregators and providers of the text message service itself.

Text messages. We send text messages only to people who have checked the optional SMS consent box on our application or contact form and provided a mobile number. That consent applies to messages from InstaCapital Funding only, and covers messages about your application and account — status updates, document requests, offer notices, and scheduling. We do not send unsolicited promotional texts. See our SMS Terms for program details.

Phone calls. Separately, where you consent on our application, we and the funding partners we submit your file to may contact you by phone about your financing request, including by automatic telephone dialing system or artificial or prerecorded voice. This phone consent is distinct from your text message consent, and neither is a condition of receiving financing or of any purchase. If you decline either, we will communicate with you by email instead.

Withdrawing consent. You can withdraw consent at any time. Reply STOP to any text message to stop texts, tell us on any call, or email info@instacapitalfunding.com. We honor opt-out requests made by any reasonable means and act on them promptly.

7. How we protect information

We maintain administrative, technical, and physical safeguards designed to protect the information we hold. These include encryption of data in transit and at rest with our document platform, multi-factor authentication on business systems, access limited to personnel who need it, and vendor agreements requiring confidentiality.

Sensitive documents such as bank statements are collected and stored through a third-party encrypted electronic signature and document platform. They are never uploaded to or stored on this website, and we do not accept them as email attachments.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a breach affecting your information, we will notify you as required by applicable law.

8. How long we keep information

We keep application information and records for as long as needed for the purposes described in this policy and to meet legal, regulatory, and recordkeeping obligations — including records of consent, disclosures, and transactions. Where we no longer need information, we delete it or render it unreadable.

Consent records are retained for at least the period of any applicable statute of limitations, because they document what you authorized.

9. Your choices and rights

• Withdraw your authorization. Email info@instacapitalfunding.com or call (307) 227-6577 and we will stop submitting your file to funders. We cannot retrieve information already provided to a funder; we will give you that funder’s contact details so you can address it with them directly.
• Stop calls and texts. Reply STOP to any text, tell us on a call, or email us.
• Stop marketing email. Use the unsubscribe link in any marketing message, or email us. We will still send messages necessary to service an application you have in progress.
• Access, correct, or delete. Email info@instacapitalfunding.com to ask what we hold about you, to correct it, or to request deletion. We will respond as required by applicable law, subject to records we must retain.

10. State privacy rights

Several states give residents rights over personal information, including rights to know what is collected, to access and correct it, to request deletion, to opt out of sale or targeted advertising, and not to be discriminated against for exercising those rights. Where a state law applies to us and to you, we will honor those rights.

To exercise a right, email info@instacapitalfunding.com or write to us at the address in section 15, and tell us the state you reside in. We may need to verify your identity before responding. You may use an authorized agent where state law permits; we may ask for proof of authorization.

As stated in section 5, we do not sell personal information or share it for cross-context behavioral advertising, so there is nothing for you to opt out of in that respect.

11. Cookies and analytics

This site uses cookies and similar technologies to keep the site working, remember preferences, and measure traffic. We use third-party analytics services to understand how visitors use the site, including which pages are viewed and where people leave a form. These providers may set their own cookies and process data under their own policies.

Most browsers let you refuse or delete cookies through their settings. Some parts of the site may not work correctly if you do. We do not use cookies to serve you advertising based on your activity on other sites.

12. Other sites

This site links to sites we don’t control, including funding partners and our document platform. We aren’t responsible for their content or privacy practices. Read their policies before giving them information.

13. Children

This site and our services are intended for businesses and for individuals aged 18 and over. We do not knowingly collect information from children. If you believe a child has provided us information, contact us and we will delete it.

14. Changes to this policy

We may update this policy. When we do, we will change the “last updated” date above, and for material changes we will provide additional notice where required. Continued use of the site after a change means you accept the updated policy.
